"Managerial capacity"means that the employee primarily manages the organization, controls the work of other supervisors, or manages a function, has the authority to hire or fire, exercises discretion over the day-to-day operations or function for which the employee has authority.
"Executive capacity"means that the employee primarily directs the management, establishes goals and policies, and exercises wide latitude in decision-making.
To obtain L-1A status, the employee must prove that:
1.You are responsible for managing either the organization as a whole or a department
2.You supervise and control the work of other supervisory, professional or managerial employees
3.If you manage personnel, you have the authority to hire and fire
4.You must demonstrate that you oversee the day-to-day operations of the activity or function you manage
5.You will spend a significant portion of time
Only those supervisors who manage professional employees can qualify for an L-1A visa under manager status.
